MINUTE ORDER Denying Without Prejudice Petition. Having reviewed the record and the Parties' submissions, (see ECF Nos. 1, 3, 5, 7 ), the Court concludes that Petitioner is detained under § 1225(b)(1)(B)(ii) and that Padilla v. U.S. ICE, No. 24-2801, 2026 WL 2822044, --- F.4th --- (9th Cir. 21, 2026), is not applicable. Because Petitioner has failed to establish that the length of his detention under 8 U.S.C. § 1225(b) violates due process such that he would be entitled to a bond hearing under Banda v.
