TEXT ORDER: The Court is in receipt of pro se Petitioner's emergency letter at ECF No. 3 . Petitioner represents that, notwithstanding the Court's September 16, 2026 Order at ECF No. 2, which enjoined Respondents from transferring Petitioner from New Jersey pending further Order of the Court, he was transferred on or about September 25, 2026, to North Lake Correctional Facility in Michigan. The September 16, 2026 Order remains in full force and effect. Respondents shall therefore take all necessary steps to return Petitioner to New Jersey forthwith. If Respondents contend that the transfer occurred before they received ECF No. 2 or that compliance with the Order was otherwise impossible, they shall so state in the letter required below and identify the date and time on which they received ECF No. 2, the date and time of Petitioner's transfer, and the basis for that contention. Upon Petitioner's return to New Jersey, Respondents shall release Petitioner within twenty-four (24) hours if (1) Petitioner is not subject to a final order of removal; (2) Petitioner was most recently apprehended in the interior of the country, as alleged in the Petition; (3) Respondents had not issued a Notice of Custody Determination by the time the Petition was filed; and (4) Petitioner has no criminal history. Any such release shall occur in New Jersey and without additional conditions. If these conditions are satisfied and Petitioner is released, Respondents need take no further action in this matter other than filing a letter certifying Petitioner's return and release within twenty-four (24) hours thereof. By October 1, 2026, Respondents shall file a letter, not to exceed two pages, stating (1) whether Petitioner has a criminal history; (2) whether Petitioner is subject to a final order of removal; (3) whether a Notice of Custody Determination had been issued by the time the Petition was filed; and (4) the statutory authority, if any, under which Petitioner remains detained. If Respondents contend that Petitioner remains detained pursuant to 8 U.S.C. § 1226(a) and has not received an individualized bond hearing before an immigration judge, Respondents shall also state when such a hearing will occur. If Respondents contend that Petitioner's detention is governed by 8 U.S.C. § 1225(b)(2), Respondents shall address the application of Buele Morocho v. Warden Philadelphia FDC, Nos. 26-1150, 26-1454, 2026 WL 2546223 (3d Cir. Aug. 28, 2026). So Ordered by Judge Zahid N. Quraishi on September 30, 2026.(kas) (Entered: 09/30/2026)

TEXT ORDER: The Court has reviewed Respondents' letter at ECF No. 7 and the accompanying exhibits. Respondents represent that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and that, on September 12, 2026, ICE issued Petitioner a Notice of Custody Determination authorizing his release upon the posting of a $7,500 bond. Respondents further represent that Petitioner requested a redetermination hearing before an immigration judge and that, following his transfer to Michigan, Petitioner expressed to immigration officials a desire to post the previously authorized bond. Id. Respondents further represent that ICE is in the process of returning Petitioner to New Jersey. Id. The Court's September 16, 2026 Order at ECF No. 2 remains in full force and effect. Respondents shall take all necessary steps to return Petitioner to New Jersey forthwith. Upon Petitioner's return, Respondents shall promptly facilitate Petitioner's release upon the posting of the previously authorized $7,500 bond if Petitioner elects to post that bond. If Petitioner does not elect to post the authorized bond and instead wishes to proceed with the bond- redetermination hearing he previously requested, Respondents shall promptly facilitate that hearing before an immigration judge. Respondents shall file a letter advising the Court of Petitioner's return to New Jersey and, within twenty-four (24) hours thereafter, whether Petitioner has been released or, if Petitioner has elected to proceed with a bond- redetermination hearing, when that hearing is scheduled. The Court will take further action as appropriate upon receipt of that letter. So Ordered by Judge Zahid N. Quraishi on 10/6/2026. (kas, ) (Entered: 10/06/2026)
