ELECTRONIC ORDER: Before the Court is Petitioner's Emergency Motion for Temporary Restraining Order (the "Motion") [Doc. 3] filed by Petitioner Molis Augustave in which he urges the Court to temporarily stay his imminent removal to Haiti pending adjudication of his recently-filed emergency motion to reopen removal proceedings by the Board of Immigration Appeals (BIA). The Court held an expedited telephonic hearing with counsel for Petitioner and the government. Considering Petitioner's currently valid final order of removal and the limitations on the jurisdiction of this Court pursuant to 8 USC 1252(g), and on the showing made by Petitioner, the Court declines to enter ex parte injunctive relief staying his removal. Accordingly, the Motion is denied. The court directs the clerk of court to serve the respondents forthwith and refers the Petition for Writ of Habeas Corpus [Doc. 1] to the Magistrate Judge to issue an expedited briefing schedule and, thereafter, a report and recommendation on the merits of Petitioner's claims.
