TEXT ORDER: This matter comes before the Court upon a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 ("Petition"). (ECF No. 1.) The Court has reviewed the Petition (ECF No. 1) and Respondent's Letter (ECF No. 4). Respondents indicate that Petitioner is detained pursuant to 8 U.S.C. § 1226(a). To the extent Petitioner challenges the lawfulness of his detention under 8 U.S.C. § 1226(a), the Court notes that a noncitizen detained pursuant to § 1226(a) may request a bond hearing before an Immigration Judge pursuant to 8 C.F.R. §§ 236.1(d)(1) and 1236.1(d)(1). See Jennings v. Rodriguez, 583 U.S. 281, 306 (2018). The Response indicates that a bond hearing was held on September 17, 2026, and that the Immigration Judge denied bond. The present record provides no basis upon which the Court may grant habeas relief. Accordingly, the Petition is DISMISSED WITHOUT PREJUDICE as to Petitioner's ability to reopen this matter should he otherwise seek judicial review of the legality of his continued detention.
