MINUTE ORDER signed by Magistrate Judge Christopher D. Baker on 09/16/2026: The Court has reviewed Petitioner's petition for writ of habeas corpus. (Doc. 1 ). The pleadings appear to raise factual and legal issues that the Ninth Circuit has resolved in holding that 8 U.S.C. § 1226(a) provides the proper framework for detention by immigration authorities of noncitizens already residing in the United States. See Rodriguez Vasquez v. Bostock, 183 F.4th 1160, 1172 (9th Cir. 2026) (holding that section 1226 "is best understood as governing inadmissible and deportable aliens present in the interior of the United States."). Moreover, to the extent Petitioner's detention implicates 8 U.S.C. § 1226(c), his alleged prolonged detention may require the government to facilitate a bond hearing. See Rodriguez Diaz v. Garland, 53 F.4th 1189, 1198-99 (9th Cir. 2022) (citations omitted). Accordingly, pursuant to 28 U.S.C. § 2243, the Court HEREBY ORDERS Respondents to SHOW CAUSE in writing no later than 9/29/2026 as to whether there are any factual or legal issues in this case that render it distinct from this Court's numerous holdings that petitioners arrested by immigration authorities within the interior of the United States are entitled to either immediate release or a bond hearing and would justify denial of the writ. Respondents' response SHALL provide the Court with copies of referenced/relevant portions of Petitioner's A-File and other supporting documents, including notices to appear, orders and other documents relating to Petitioner's release from custody, and documents related to any asserted violations of release conditions or any asserted change of circumstances warranting Petitioner's detention. MINUTE ORDER (Text Only Entry) Petitioner initiated this action with a petition challenging his detention with a petition for writ of habeas corpus under 28 U.S.C. § 2241. (Doc. 1 .) On August 11, 2026, an immigration judge granted Petitioner's application for relief under the former INA § 212(c). (Doc. 7-1 at 12.) Respondents report that the Department of Homeland Security did not appeal the decision, and Petitioner was released from custody on September 14, 2026. (Doc. 7 at 1.) A routine review of the online ICE detainee locator confirms that Petitioner is no longer in ICE custody following the IJ's order granting relief from removal. Therefore, the petition is DISMISSED as MOOT. The Clerk of Court is directed to terminate pending matters and CLOSE this case signed by District Judge Jennifer L. Thurston on September 22, 2026.
