TEXT ORDER - : The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Yoel Alexander Peguero-Santana ("Petitioner"). (ECF No. 1.) According to the Petition, Petitioner is a native and citizen of the Dominican Republic who entered the United States without inspection on October 28, 2000, and has remained here since that time. Petitioner alleges that he is subject to a final order of removal entered in absentia in 2001, for which he has filed a Motion to Reopen with the Immigration Court. Petitioner further alleges he is married to a United States citizen whose Form I-130 petition on his behalf was approved on September 11, 2026, and that immediately following the interview with a United States Citizenship and Immigration Services officer through which his Form I-130 petition was approved, he was taken into custody by ICE and transferred to Delaney Hall Detention Center where he remains detained. Petitioner contends that his continued detention violates 8 C.F.R. § 1003.23(b)(4)(ii), the Due Process Clause of the Fifth Amendment, and the Administrative Procedures Act. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE within seven (7) days of the filing of this Order, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on September 16, 2026.
