TEXT ORDER: The Court is in receipt of Respondents' letter addressing Petitioner's criminal history, final order of removal, and detention authority. (ECF No. 5 .) Respondents represent that Petitioner is detained pursuant to 8 U.S.C. § 1231(a)(5), following reinstatement of a prior order of removal, and that Petitioner has been detained for approximately twelve days. (Id.) Because Petitioner's detention is presently well within the presumptively reasonable six-month period recognized in Zadvydas v. Davis, 533 U.S. 678, 701 (2001), any challenge to the duration of Petitioner's detention is premature at this time. Accordingly, the Petition is DISMISSED WITHOUT PREJUDICE as premature.
