MINUTE entry before the Honorable Edmond E. Chang: Emergency telephone motion hearing held on the Petitioner's motion for TRO, R. 3. Counsel for the Petitioner and the government appeared by telephone. As acknowledge in the motion and the petition, R. 1, 3, a final order of removal has been entered (long ago). Although the Petitioner has filed a motion to reopen and a motion to stay with the BIA, this Court has no subject matter jurisdiction over a claim, like this one, that arises out of the execution of a removal order. 8 U.S.C. 1252(g); Sharif ex rel. Sharif v. Ashcroft, 280F.3d 786, 787-88 (7th Cir. 2002). And there is no exception under the statute for the pendency of a motion to re-open. The petitioner's motion for TRO 3 is denied. The parties shall confer on whether there is any other relief to pursue in this case, and shall file a joint status report by 12/29/2025.
