Minute Entry for proceedings held before Judge Diana Saldana. CONFERENCE regarding Preliminary Injunction Hearing held on 9/23/2025. Preliminary Injunction Hearing is continued - other matters and deadlines are discussed. Respondents Motion to Dismiss is pending (Dkt. No. 7) with the Petitioners response currently due September 25, 2025. No objection by Respondent to a two-week extension of response deadline to motion to dismiss by Petitioner. The Court received and reviewed the Advisory by the Respondent and then was in receipt of the Motion for TRO filed by the Petitioner. The Court also notes that Respondent filed their response the Motion for Temporary Restraining Order late yesterday afternoon. Deadline for Petitioner to file their reply to response to TRO (Dkt. No. 21) is now set for Friday, September 26, 2025. Attorney Sandoval-Moshenberg does inform that he has the notice for the initial notice to appear (of the petitioner) from 2024 and will be attaching it to one of the filings. Separate Order to be issued by the Court: setting the deadline for reply to the Petitioners response, deadline for Petitioner to file their response to the Motion to dismiss, and the date of the Preliminary Injunction Hearing. All parties announce they are available on September 29th. The Court will extend the Temporary Restraining Order and will schedule the Preliminary Injunction Hearing on Monday, September 29, 2025, at 9:00 AM. TIME: 10:01 AM - 10:13 AM. Minute Entry for proceedings held before Judge Diana Saldana. PRELIMINARY INJUNCTION HEARING held on 9/29/2025. Preliminary Injunction Hearing begins. The Court informs the parties that she has reviewed the additional briefing and has some additional questions that hopes will guide the proceeding. The first issue is as to Jurisdiction. The parties responses and arguments on jurisdiction begin at 8:55 AM with attorney for petitioner on the record. Respondents reply begins at 8:58 AM, AUSA Ramirez also comments that he believes their position was also mentioned in their Motion to Dismiss. The Court goes on to discuss the issue of D.V.D. with the parties. Arguments begin at 9:00 AM with Respondents attorney on the record - raising three issues, stating that if the Court abstains it can cause irreparable harm. 9:07 AM Respondents reply to the Petitioners argument on the issue (D.V.D.) on the record - Government agrees that D.V.D. does not strip this Court of jurisdiction, but the Court should abstain (reasons on the record). 9:09 AM - Attorney Sandoval-Moshenberg references a review of the fear interview informing that it was an administrative officer who checked the box with no reasoning that one can see behind it (three prong argument follows, placed on the record). 9:16 AM - Respondents reply and argument on the record. 9:23 AM - Reply by the Government (respondent) on the record regarding argument on credible fear (further stating there is nothing but speculation about irreparable harm in the position that the matter is in right now). Discussion on balance of equity. The Court informs she has no further questions for the parties. 9:24 AM - Petitioners attorney, Mr. Sandoval-Moshenberg, reiterates earlier arguments. Nothing further from Respondent, believes that all information has been provided. The Court informs the parties that TRO is extended while the Motion for Preliminary Injunction is under consideration. The Court expects that she will be able to make a decision in the next couple of days and the TRO will be extended until that ruling is made. TIME: 8:52 AM - 9:27 AM.
