Judge Richard G. Stearns: ELECTRONIC ORDER entered re 10 Response to Petition for Writ of Habeas Corpus - 2241 filed by Markwayne Mullin, David Wesling, Todd Blanche, David J. Venturella. The court agrees with the government that Petitioner Cleidimar Estevao Goncalves, a 48-year-old native and citizen of Brazil who entered the United States without inspection in 2023, and has resided in the country since that time, is eligible for a bond hearing. As the United States Immigration and Customs Enforcement (ICE) has detained Estevao Goncalves since September 9, 2026 (who voluntarily appeared for a scheduled ICE check-in at the ICE Enforcement and Removal Operations field office in Burlington, Massachusetts), the court directs the government to arrange a bond hearing for her before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Friday, September 25, 2026.
