ORDER OF COURT. Petitioner filed a Petition for Writ of Habeas Corpus on 09/09/2026, seeking his release from immigration custody and also noting that he has not been afforded an individualized bond hearing. Recognizing the United States Court of Appeals for the Third Circuit's recent decision in Buele Morocho v. Warden Philadelphia FDC, -- F.4th --, 2026 WL 2546223 (3d Cir. Aug. 28, 2026), ICE conducted a custody determination, and, on 09/10/2026, Petitioner elected to have an immigration judge review his custody determination. (ECF No. 7-1). The immigration court has scheduled a bond hearing for 10/06/2026. (ECF No. 7-2). Consequently, the Court will deny his habeas petition as moot as the only relief it would afford Petitioner is an individualized bond hearing before an immigration judge.
