TEXT ORDER: This matter is before the Court on Respondents' letter (Letter) (ECF No. 5 ) filed pursuant to this Court's September 16, 2026 Order (Order) (ECF No. 3 ). According to the Letter, pro se Petitioner was granted release on bond under 28 U.S.C. § 1226(a) and declined a hearing with an immigration judge ("IJ") to review his detention. (ECF No. 5 at 1-2.) Respondents ask the Court to vacate the Order to the extent it directs immediate release. (Id. at 3 .) Respondents request is GRANTED. Petitioner is lawfully detained under § 1226(a) and has declined to pursue the administrative remedy available to him by requesting a custody redetermination hearing before the IJ. The Court VACATES its Order (ECF No. 2 ) to the extent it orders that Respondents shall immediately release Petitioner. Respondent is directed to file a response to the Petition within five (5) days from the date of the Court's Text Order.
