MEMORANDUM (Order to follow as separate docket entry) re 23 MOTION to Notify Status of Immigration Bond Hearing; MOTION to Overturn Immigration Judge's Ruling of Denial of Bond; MOTION for Order Immediate Release or in the Alternative Order Bond-Rehearing with a Constitutional Article 2 Judge filed by Francis F. Joseph. For the foregoing reasons, the petitioners motion to enforce will be granted, the immigration judges bond decision of March 2, 2026, will be vacated, and the governm ent will be directed to provide Joseph with a constitutionally adequate individualized bond hearing before an immigration judge, at which he may be represented by counsel retained at his own expense. Our order granting this relief will require that t he bond hearing be conducted within a specified period of time, but that time period may be subject to a reasonable extension of time if necessary, whether by mutual agreement of the parties or by a motion for an extension of time filed in this habeas court, which shall be granted for good cause shown.An appropriate order follows.Signed by Honorable Joseph F. ORDER granting 23 Motion to enforce the court's prior judgment granting habeas relief. In accordance with the accompanying Memorandum, IT IS HEREBY ORDERED THAT:1.The petitioners motion to enforce the courts prior judgment granting habeas r elief (Doc. 23) is GRANTED;2.The immigration judges bond decision of March 2, 2026, is VACATED;3.The government shall either provide Joseph with a constitutionally adequate individualized bond hearing within twenty-one (21) days after entry of this o rder or release Joseph on his own recognizance;4.The foregoing time period may be extended for a reasonable period of time by mutual agreement of the parties or by a motion for an extension of time filed with this habeas court, see Fed. R. Civ. P. 6( b);5.At this individualized bond hearing, the petitioner may be represented by counsel at his own expense, and the government shall bear the burden of proving by clear and convincing evidence that the petitioners continued detention is necessary to p revent him from fleeing or harming the community;6.The respondent shall file a written notice of the outcome of this individualized bond determination by an immigration judge within seven (7) days after the date of the hearing; and7.The clerk is directed to mark this case as CLOSED.
