Order of Dismissal: The Petition [ECF 1] filed on 12/16/2025 is dismissed without prejudice for lack of jurisdiction. Petitioner seeks habeas and injunctive relief to prevent his imminent detention. See [ECF 1] at p. 1 and 8. A habeas petitioner, however, must be in custody. See Hensley v. Municipal Court, 411 U.S. 345, 351-53 (1973). Because Petitioner is not in custody, this Court lacks jurisdiction. I deny issuance of a certificate of appealability because the Petitioner has not made a substantial showing of the denial of a constitutional right at this time. 28 U.S.C § 2253(c)(2).
