TEXT ORDER: It does not appear that the Petitioner was detained within this District when the petition was filed. See Respondents' Aug. 25, 2026 Letter (ECF 4); Declaration of Ruben Perez, Jr. (ECF 6) 5-6. So the Court may not have jurisdiction. See Khalil v. Joyce, 777 F. Supp. 3d 369, 393-96 (D.N.J. 2025). In light of the above, the Court is inclined to transfer this case to the Western District of Pennsylvania. See 28 U.S.C. § 1631 (empowering district courts to transfer civil cases to courts in which they could have been filed to address jurisdictional defects). Any party objecting to this proposed course of action shall file a short letter brief on or before August 28 at 5:00pm.. So Ordered by Judge Michael E. Farbiarz on 8/26/26. CASE MANAGEMENT ORDER: The Court orders as follows: 1. Service. The Court hereby notifies Petitioner that copies of this order and the Petition were emailed by the Court to the United States Attorney's Office for the Western District of Pennsylvania this day. Li, 29 I. & N. Dec. 66 (BIA 2025) and Matter of Yajure Hurtado, 29 I. & N. Dec. 216 (BIA 2025), and as more fully stated in said Case Management Order. Signed by Judge Stephanie L. ORDER - For the reasons stated in this Order, it is hereby ORDERED as follows: 1) The Petition for Writ of Habeas Corpus, ECF No. 1, is GRANTED to the extent it seeks an individualized bond hearing before an immigration judge. 2) The Government is directed to provide Petitioner with the statutory process required under 8 U.S.C. § 1226(a), which includes a bond hearing. 3) The bond hearing shall include an individualized determination of whether Petitioner poses a danger to the community or a flight risk under the ordinary Section 1226(a) framework. The immigration judge shall state the reasons for the custody determination orally on the record or in writing. If bond is denied, the immigration judge shall identify the principal facts and evidence relied upon in determining that Petitioner poses a danger to the community, a flight risk, or both. Nothing in this Order requires the immigration judge to reach any particular custody determination. 4) The Government shall arrange for a individualized bond hearing to be conducted by an immigration judge within 30 days of the issuance of this Order. 5) If Petitioner is not provided with a bond hearing within 30 days of the issuance of this Order, or if the immigration judge declines jurisdiction or denies eligibility for a bond hearing, Respondents shall immediately release Petitioner from custody. 6) If Petitioner is granted bond and the Government appeals the immigration judge's decision, then, upon notification to this Court, the writ shall issue and Petitioner shall be automatically released from custody. 7) With no further action required by the Court at this time, the Clerk of Court shall mark this matter closed, and as more fully stated in said Order. Signed by Judge Stephanie L. Haines on 9/22/2026. (dlg) (Entered: 09/22/2026)
