ORDER GRANTING PETITION FOR WRIT OF HABEAS CORPUS by Magistrate Judge Douglas F. McCormick, 1 . IT IS ORDERED that: 1. The Petition (Dkt. 1) is GRANTED. 2. Respondents shall immediately release Petitioner Kathia Belen Rugama Perez (A# 240-770-478) from custody on the conditions in place prior to her October 15, 2025 re-detention. Concurrently upon her release, Respondents shall return to Petitioner her personal identity documents and other property taken from her upon her October 15, 2025 re-d etention, including her Employment Authorization Document, California identification card, and Social Security card. Within three (3) days, Respondents shall file a status report confirming compliance. 3. Respondents are enjoined from detaining Petit ioner under 8 U.S.C. § 1226(c)(1)(E)(ii) solely on the basis of the September 4, 2025 GGPD incident described herein, absent a material change in circumstances that would make such detention lawful. 4. Any application for fees and costs under th e Equal Access to Justice Act, 28 U.S.C. § 2412, shall be filed in accordance with that statute. 5. Petitioner's remaining requests are DENIED.
