ORDER: Petitioner's petition for writ of habeas corpus (Doc. 1 ) is GRANTED to the extent it seeks a bond hearing. Respondents must provide petitioner a bond hearing within seven days of this order being docketed at which they must justify petitioner's continued detention by a showing of clear and convincing evidence that he would likely flee or pose a danger to the community if released, or release him from custody under the same conditions that existed before petitioner's detention. Respondents must provide a notice of compliance within three days of releasing petitioner or providing petitioner a bond hearing, including the outcome of the bond hearing. All pending motions are DENIED AS MOOT and the Clerk of Court shall enter judgment in petitioner's favor and close this case. The Clerk of Court must immediately transmit by email a copy of this Order to the United States Attorney for the District of Arizona, to the attention of Melissa Kroeger at melissa.kroeger@usdoj.gov, Lon Leavitt at lon.leavitt@usdoj.gov, Theo Nickerson at Theo.Nickerson2@usdoj.gov, Dina Anagnopoulos at Dina.Anagnopoulos@usdoj.gov, and Mary Finlon at Mary.Finlon@usdoj.gov. ORDER On September 17, 2026, the Court granted Petitioner's writ of habeas corpus because respondents had failed to oppose it. (Doc. 8 .) That order required respondents to provide Petitioner a bond hearing within seven days or release him from custody under the same conditions that existed before his detention. Five days later, Petitioner filed a "Pro Se Request for Immediate Release Because Respondents Did Not Respond, Without Affecting the Relief Already Ordered." (Doc. 10.) Petitioner's motion, filed before the expiration of the timeline in which the Court required relief, amounts to a motion for reconsideration. The motion does not identify any relevant fact or argument the Court did not consider in its prior order. See D. Ariz. L.R. 7.2(g). Instead, it asks the court "to rethink what the court has already thought through-rightly or wrongly." Ramirez v. Medtronic Inc., 961 F. Supp. 2d 977, 1005 (D. Ariz. 2013) (simplified). That is not appropriate. IT IS ORDERED the Request for Immediate Release (Doc. 10 ) is DENIED. Ordered by Judge Krissa M Lanham on 9/24/2026. (ESG)(This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (Entered: 09/24/2026)
