FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Allison Claire on 3/10/2026 RECOMMENDING the 1 Petition for Writ of Habeas Corpus be granted as to petitioner's Fifth Amendment due process claim regarding prolonged detention, regulato ry and Fifth Amendment due process claims regarding revocation of release, and Fifth Amendment due process claim regarding the government's third-country removal program. It is FURTHER RECOMMENDED that the petitioner be immediately released unde r the same conditions of release prior to the 7/14/25 re-detention and to provide petitioner with a copy of the release order. Respondents are permanently enjoined and restrained from seeking to revoke petitioner's supervision unless they comply with all procedures and are permanently enjoined and restrained from removing petitioner to a third country. Within 3 days of the Adopting of these Findings and Recommendations, respondent is directed to file a notice of compliance confirming petitioner's release and the conditions of the supervision. The Court is directed to enter judgment in favor petitioner and to close this case. Referred to Judge Dena Coggins. Objections to these F&R's due within 7 days. (Deputy Clerk AMW)

Respondents shall IMMEDIATELY RELEASED Petitioner Vu Quoc Pham from ICE custody under the same conditions of release to which he was subject prior to his 7/14/2025 re-detention. If Respondents have custody of petitioner's documents, Respondents shall return those to Petiti oner at the time of release. Respondents are PERMANENTLY ENJOINED AND RESTRAINED from seeking to revoke petitioner's supervision unless and until they comply with all procedures set forth in 8 C.F.R. § 241.13(i), any other applicable statut es and regulations, and the requirements of due process.
