TEXT ORDER: In his Motion for Temporary Restraining Order (T.R.O.), ECF No. 5, Petitioner seeks his immediate release. Seeking immediate release goes beyond the "limited nature of a [T.R.O.]" and instead requests "mandatory, affirmative relief[,]" which may not be afforded via a T.R.O. Hope v. Warden York County Prison (Hope I), 956 F.3d 156, 162 (3d Cir. 2020) (finding that where the district court purported to enter an ex parte T.R.O. but directed the release of twenty petitioners, the relief altered the status quo, exceeding the temporary and limited nature of a [T.R.O.]) (citing Granny Goose Foods Inc. v. Brotherhood of Teamsters and Auto Truck Drivers Local, 415 U.S. 423, 439 (1974)). Therefore, Petitioners 5 Motion for Temporary Restraining Order is DENIED. MEMORANDUM ORDER - IT IS ORDERED that the petition for a writ of habeas corpus (ECF No. 1 ) hereby is GRANTED. Respondents are directed to provide Petitioner with the statutory process required under 8 U.S.C. § 1226(a), which includes a bond h earing before a neutral immigration judge within thirty (30) days of this Order; and, IT IS FURTHER ORDERED that the bond hearing shall include an individualized determination of whether Petitioner poses a danger to the community or a flight risk und er the ordinary § 1226(a) framework. The immigration judge shall state the reasons for the custody determination orally on the record or in writing. If bond is denied, the immigration judge shall identify the principal facts and evidence relied upon in determining that Petitioner poses a danger to the community, a flight risk, or both. Nothing in this Order requires the immigration judge to reach any particular custody determination; and IT IS FURTHER ORDERED that if Petitioner is not provi ded with a bond hearing by the timeframe specified, or if the immigration judge declines to conduct a bond hearing based on Matter of Yajure Hurtado, 29 I&N Dec. 216 (BIA 2025) or related grounds that this Court has rejected, the writ shall issue and Respondents shall immediately release Petitioner from custody; and, IT IS FURTHER ORDERED that Magistrate Judge Ormsby's Report and Recommendation (ECF No. 12 ) is adopted in part as the Opinion of the Court; and, IT IS FURTHER ORDERED that th e Motion for Preliminary Injunction (ECF No. 2 ) is denied as moot; and, IT IS FURTHER ORDERED that the Clerk of Court is directed to mark this matter closed, and as more fully stated in said Memorandum Order.
