TEXT ORDER: In their Amended Answer ECF No. 9, Respondents ask the Court to dismiss as premature Petitioner's habeas petition because he is currently within the 90-removal period. ECF No. 9 . This Court rejects that contention as his removal order was entered in 2005 and the 90-day statutory period has long expired. Petitioner's detention is governed by Zadvydas v. Davis, 533 U.S. 678, 701 (2001), which limits the time that government may detain aliens who have been found removable to that reasonably necessary to effect removal and sets a 6-month presumptive period of detention. A detainee is not precluded from challenging the reasonableness of his detention before such time, however. See Munoz-Saucedo v. Pittman, 789 F.Supp.3d 387, 395 (D.N.J., 2025). Here, Respondents initially claimed that they were detaining Petitioner under 8 U.S.C. § 1225(b)(2) and have provided no evidence in their amended response that Petitioner's removal is reasonably likely to occur; moreover, Petitioner has alleged extraordinary circumstances concerning his son's health. See ECF No. 12 . Therefore, Counsel shall appear before the undersigned at 3/4/2026 at 11:00 AM at which time the government shall SHOW CAUSE why petitioner should not be released with appropriate supervision while his appeal is pending. For that purpose, the government shall produce a witness from ICE to answer questions concerning procedural next steps in petitioner's case, the reasons behind petitioner's arrest and continued detention, the circumstances (housing, daily schedule, visitation) of his detention, and a plan for supervision deemed adequate in the event of petitioner's release.
