ORDER GRANTING PETITIONER'S PETITION FOR WRIT OF HABEAS CORPUS UNDER 20 U.S.C. SECTION 2241 AND ORDERING HIS IMMEDIATE RELEASE by Judge Andre Birotte Jr.: Petitioner Francisco Javier Rodriguez Sanabia's (A# 205-157-155) Petition for Writ of Habeas Corpus Under 28 U.S.C. section 2241 1 is GRANTED. Petitioner's Motion for Temporary Restraining Order 3 is DENIED AS MOOT. Respondents must IMMEDIATELY RELEASE Petitioner Francisco Javier Rodriguez Sanabia (A# 205-157-155) from custo dy in the same position he was in before he was arrested on 8/24/2026. At the time of release, Respondents must return all of Petitioner's documents and possessions. To avoid further irreparable harm and protect the public interest, Respondents are ENJOINED and RESTRAINED from re-detaining Petitioner unless and until a hearing can be held before a neutral arbitrator to determine whether his re-incarceration would be lawful. Respondents are also ENJOINED and RESTRAINED from placing Petitioner on any GPS/electronic monitoring devices upon his release. See document for further details. (gk)
