TEXT ORDER - The Court has received Respondents' expedited answer, which acknowledges that, on August 28, 2026, the Third Circuit held that noncitizens who entered the United States without admission or inspection and are later arrested in the interior of the country may not be detained without bond under Section 1225(b)(2), see Buele Morocho v. Warden Philadelphia FDC, --- F.4th ---, ---, 2026 WL 2546223, at *2-10 (3d Cir. 2026), and affirmed the release of two noncitizens with no criminal histories and significant ties in the United States. On that basis, Petitioner's habeas petition is GRANTED. The Petition alleges that Petitioner has resided in the United States since 2022 (ECF No. 1, Petition at 4), and, according to Respondents, she has a history of traffic infractions and alleged noncompliance with alternatives to detention ("ATD"). (ECF No. 4.) Neither is criminal in nature, and the Court directs Respondents to release Petitioner within 24 hours and file a letter on the docket within three (3) days confirming her release and requesting to close this matter.
