TEXT ORDER -The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, filed by Petitioner, Basilio Perez Mahuis ("Petitioner"). (ECF No. 1.) The Petition alleges that Petitioner is a native and citizen of Mexico who last entered the United States in or around 1999 and has remained here since. Petitioner alleges that on August 22, 2026, he was arrested by immigration authorities in Newark, New Jersey, and that he has remained in immigration custody at Delaney Hall Detention Facility since that date. Petitioner alleges he resides in Naugatuck, Connecticut, with his longtime partner and two adult United States citizen children, and that he has another adult daughter who resides elsewhere. Petitioner alleges that he has no significant criminal history apart from minor traffic-related offenses, including a DUI approximately five years ago. Petitioner challenges Respondents' determination that he is subject to mandatory detention under 8 U.S.C. § 1225(b), asserting that his circumstances instead place him within the general detention authority of 8 U.S.C. § 1226(a), under which he is entitled to seek discretionary release on bond before an Immigration Judge. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE within seven (7) days of the filing of this Order, why the Petition should not be granted. Petitioner may file a reply Order, within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on September 1, 2026.
