MINUTE ORDER (Text Only Entry: The Court has reviewed petitioner's 1 petition for writ of habeas corpus and 2 motion for temporary restraining order. The 2 motion states that petitioner previously filed a petition for writ of habeas corpus raising the same claims in the Central District of California on 10/2/2025 and that petitioner was subsequently transferred to this district. Given that petitioner already has a pending filing in the Central District of California raising the same issues, see Chowdhury v. Janecka, 5:25-cv-02634-SSS-DSR (C.D. Cal.), petitioner shall show cause why this Court should not decline jurisdiction over petitioner's new filing in this district. "[W]hen the Government moves a habeas petitioner after she properly files a petition naming her immediate custodian, the District Court [where the petition was filed] retains jurisdiction and may direct the writ to any respondent within its jurisdiction who has legal authority to effectuate the prisoner's release." Rumsfeld v. Padilla, 542 U.S. 426, 441 (2004) (citing Ex parte Endo, 323 U.S. 283 (1944)). And the first-to-file rule provides that a district court may "decline jurisdiction over an action when a complaint involving the same parties and issues has already been filed in another district." Pacesetter Sys., Inc. v. Medtronic, Inc., 678 F.2d 93, 94-95 (9th Cir. 1982). Petitioner is ORDERED TO SHOW CAUSE, by no later than 12/29/2025, why the Court should not decline jurisdiction over this matter, given that petitioner has a pending habeas petition raising the same issues in another district.
