TEXT ORDER: The Court has reviewed Petitioner Amy Abranda Peru's 1 Petition under 28 U.S.C. § 2241 seeking an order: enjoining Respondents from transferring Petitioner from the custody of the U.S. Marshals to ICE, without advance notice; enjoining Respondents from removing Petitioner from the Northern District of New York while this Petition and the appeal of her state court conviction is pending; a declaration that 8 U.S.C. § 1226(c) does not authorize Petitioner's mandatory detention while her state court appeal is pending; enjoining Respondents from taking Petitioner into civil immigration custody without a constitutionally adequate pre-deprivation opportunity to contest custody; and directing Petitioner's immediate release in the event ICE assumes custody "before the Court acts" or an immediate custody hearing. (Dkt. No. 1). It is ORDERED: (1) that Respondents file a response to the Petition by Wednesday, 9/2/2026, and that any response include updated information regarding Petitioner's location and any immigration proceedings being pursued; (2) that Petitioner shall file a reply, if any, by Tuesday, 9/8/2026; (3) that Respondents are enjoined from moving Petitioner outside the jurisdiction of the Northern District of New York until 9/9/2026; and (4) that a hearing be held by videoconference on 9/9/2026 at 12:00PM, at which point the Court will decide whether to continue the order restraining Respondents from moving Petitioner from the Northern District of New York. The Clerk of the Court is respectfully directed to serve copies of this Text Order and the Petition upon the United States Attorney for the Northern District of New York in accordance with the Local Rules.
