Judge Myong J. Joun: ELECTRONIC ORDER entered. Petitioner challenges his prolonged detention under the Due Process Clause. Doc. No. 1 . Petitioner’s detention unquestionably constitutes a “significant deprivation of liberty.” Hernandez-Lara v. Lyons, 10 F.4th 19, 27 (1st Cir. 2021) (internal quotation marks omitted). However, here Petitioner focuses on the duration of his detention, and does not identify any reason to expect that the outcome of a second bond hearing might be different than that of the first. The Court notes that Petitioner’s reasoning as to why he is no longer a flight risk, that his criminal charges were dismissed and he has a sponsor, were true during Petitioner’s first bond hearing. See generally Alas Rivera v. Moniz, 26-12175, Doc. No. 9-1 (D. Mass. May 28, 2026). Moreover, Petitioner’s appeal of the Immigration Judge’s order of removal is currently pending before the Board of Immigration Appeals. Doc. Nos. 15-1 & 15-2. Based on the record, the Court does not find that Petitioner’s detention without an additional bond hearing violates his due process rights at this stage, see Mathews v. Eldridge, 424 U.S. 319, 343 (1976) (considering the “probable value, if any, of additional procedural safeguards”). If Petitioner identifies new evidence or a relevant change in circumstances that warrants a second bond hearing, he can seek a bond redetermination under the appropriate regulations. See Lemus Tejada v. Moniz, 26-12619, Doc. No. 16 (D. Mass. July 6, 2026) (citing 8 C.F.R. § 1003.19(e)). Accordingly, the Petition for Writ of Habeas Corpus is DENIED.(SP) (Entered: 09/08/2026)
