Stearns: ELECTRONIC ORDER entered re 7 Response to Petition for Writ of Habeas Corpus - 2241, filed by Markwayne Mullin, David Wesling, Donald Trump, Jeffrey Grimming, David Venturella, Todd Blanche, and Antone Moniz. In its Response, the government presents evidence that petitioner Cleiton Toledo De Souza was convicted of Attempted Homicide in Brazil, specifically Law 2848, Article 14 and Law 2848, Article 121 § 2. He was sentenced to nine years and two months in prison. See Dkt 7-1. The arrest warrant following the final judgment was signed on August 25, 2023. Id. Accordingly, his detention is mandatory. See 8 U.S.C. § 1226(c). If Petitioner does not believe he is subject to Section 1226(c)'s mandatory detention provision, he can make make that argument in Immigration Court through a Matter of Joseph Hearing. 22 I. & N. Dec. 799 (BIA 1999). Petitioner will notify the court no later than September 14, 2026, if he intends to file with the Immigration Court or wishes to respond to the government's Response.
