TEXT ORDER: The Court has reviewed Petitioner's Amended Petition (ECF No. 2) and the Government's Response (ECF No. 5) in this matter. Petitioner asserts that he is unlawfully detained under 8 U.S.C. § 1225(b)(2). Under this Court's recent decision in Valerio v. Joyce, Civ. No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), and other recent decisions in this District interpreting § 1225, the Court agrees, and holds that Petitioner is subject to detention under § 1226(a). It is therefore ORDERED that, in accordance with 8 U.S.C. § 1226(a), within seven (7) days of the date of entry of this Text Order, Respondent shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether he presents a flight risk or a danger to the community. Within three (3) days of that bond hearing, Respondent shall file a written notice of the outcome of that hearing with this Court. It is further ORDERED that the Government shall not transfer Petitioner from his current facility prior to completion of the bond hearing. So Ordered by Judge Zahid N. Quraishi on 1/7/2026. TEXT ORDER: This Court previously determined that Petitioner was entitled to a bond hearing in this matter. (See ECF No. 6.) As Petitioner has now received that bond hearing, and secured his release on $10,000 bond, (see ECF No. 7), Petitioner has received the relief to which he was entitled in this proceeding, and this matter shall therefore be CLOSED. So Ordered by Judge Zahid N. Quraishi on 1/16/2026. (kas) (Entered: 01/16/2026)
