TEXT ORDER: This matter comes before the Court upon a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 ("Petition"). (ECF No. 1.) The Court has reviewed the Petition (ECF No. 1) and the Response (ECF No. 4). According to the Response, Petitioner is detained pursuant to 8 U.S.C. § 1226(a), and was scheduled for an individualized bond hearing pursuant to 8 U.S.C. § 1226(a) on September 2, 2026. It is ORDERED that by September 10, 2026, Respondents shall file a letter advising the Court of the outcome of the bond hearing upon which the Court will close this matter absent further relief being warranted. TEXT ORDER: The Court has reviewed Petitioner's September 9, 2026 letter advising that his September 1, 2026 individualized bond hearing did not occur and requesting immediate release. (ECF No. 6.) The Court has also reviewed Respondents' September 10, 2026 letter advising that Petitioner's individualized bond hearing has been rescheduled for September 15, 2026, at 1:00 p.m. (ECF No. 7.) The record reflects that Petitioner is a native and citizen of Mexico who entered the United States in or about 1999, without inspection or admission. (ECF No. 1 at 7; ECF No. 4-2 at 2.) On August 24, 2026, Immigration and Customs Enforcement arrested Petitioner and charged him with removability under 8 U.S.C. § 1182(a)(6)(A)(i). Petitioner remains detained at Delaney Hall Detention Facility pursuant to 8 U.S.C. § 1226(a). Because § 1226(a) authorizes discretionary detention during the pendency of removal proceedings, and Petitioner is scheduled to receive an individualized custody determination in the near future, the Court finds no basis at this time to order his immediate release. Accordingly, Petitioner's request for immediate release is DENIED. It is further ORDERED that Respondents shall file a letter advising the Court of the outcome of Petitioner's September 15, 2026 bond hearing within three (3) days of the hearing. TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1), Respondents' submissions (ECF Nos. 4, 7, 9), and Petitioner's September 9, 2026 letter (ECF No. 6). Respondents' September 18, 2026 letter advises the Court regarding the outcome of Petitioner's individualized custody determination pursuant to 8 U.S.C. § 1226(a). Because Petitioner has now received the individualized bond hearing that was the subject of this proceeding, no further relief is warranted in this habeas action.
