TEXT ORDER that the Court has reviewed the Petition 1 and the Response 3 . Petitioner alleges she is unlawfully detained under 8 U.S.C. § 1225. Under this Court's recent decision in Valerio v. Joyce, Civ. No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), and other recent decisions in this District interpreting § 1225, the Court holds that Petitioner is subject to detention under § 1226(a). It is therefore ORDERED that, in accordance with 8 U.S.C. § 1226(a), within seven (7) days of the date of entry of this Text Order, Respondent shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether she presents a flight risk or a danger to the community. Within three (3) days of that bond hearing, Respondent shall file a written notice of the outcome of that hearing with this Court. It is further ORDERED that the Government shall not transfer Petitioner from her current facility prior to completion of the bond hearing. So Ordered by Judge Zahid N. Quraishi on 12/31/2025. TEXT ORDER: The Court having reviewed the parties submissions (ECF Nos. 1, 3), and the Government having conceded that this matter is not meaningfully distinguishable from this Court's prior decisions regarding detention under 8 U.S.C. § 1225(b)(2), see, e.g., Valerio v. Joyce, Civ. No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), and in light of other recent decisions in this District interpreting § 1225(b)(2), the Court holds that Petitioner is subject to detention under 8 U.S.C. § 1226(a). It is therefore ORDERED that, in accordance with 8 U.S.C. § 1226(a), within ten (10) days of the date of entry of this Text Order, Respondents shall provide Petitioner with an individualized bond hearing before an immigration judge who shall assess whether he presents a flight risk or a danger to the community... Within three (3) days of that bond hearing, Respondents shall file a written notice of the outcome of that hearing with this Court.
