PAPERLESS ORDER Granting In Part and Denying In Part 12 Petitioner's Motion to Reopen Case, for Leave to File Reply, and for Expedited Disposition Under 28 U.S.C. § 2243 ("Motion"). In the Motion, Petitioner seeks leave to file a reply to Respondent's Response to Order to Show Cause, [ECF No. 8], after the deadline set by the Court's Order to Show Cause and Omnibus Order, [ECF No. 4]. The Court has determined that good cause exists under Federal Rule of Civil Procedure 6(b)(1)(B) to allow Petitioner to file an out-of-time reply. See Pioneer Invs. Servs., Co. v. Brunswick Assocs., Ltd. P'ship, 507 U.S. 380, 394-95 (1993) (holding that what constitutes "excusable neglect" is an equitable determination). Accordingly, Petitioner's request to file an out-of-time reply is GRANTED, and Petitioner shall separately file his Reply, [ECF No. 12] at 7-13, on the docket on or before September 23, 2026.Petitioner also renews the request in his Petition that the Court order that Respondents not transfer Petitioner outside this District while the Petition is pending. Mot. at 4; see also Pet., Prayer (b). But the Court lacks jurisdiction to enjoin Petitioner's transfer to another immigration facility. Sections 1252(a)(2)(B) and 1231(g)(1) strip the Court of jurisdiction "to enjoin the government from transferring immigration detainees to other districts, as those decisions fall within the discretion of the Attorney General." Guerra-Castro v. Parra, No. 25-CV-22487, 2025 WL 1984300, at *2 (S.D. Fla. July 17, 2025); see also Rivera Diaz v. Krome N. Serv. Processing Ctr., No. 26-CV-22704-RAR (S.D. Fla. June 11, 2026) ("[T]he Court finds that it lacks jurisdiction to grant Petitioner's request to enjoin Respondent from transferring him to another facility."). Accordingly, Petitioner's request that the Court order Respondents to give written notice before any potential transfer is DENIED. Consistent with this Court's Order to Show Cause and Omnibus Order, [ECF No. 4], Petitioner's counsel shall promptly inform the Court of any material change in Petitioner's immigration proceedings or any change to Petitioner's immigration status.Lastly, Petitioner seeks to reopen the case as briefing on the Order to Show Cause is complete. However, an administrative closure is purely a matter of court administration that in no way impacts the Court's ability to review and adjudicate the Petition when ripe. As such, Petitioner's request to administratively reopen this case is DENIED. This case shall remain administratively CLOSED.
