ORDER GRANTING IN PART AND DENYING IN PART PETITION FOR WRIT OF HABEAS CORPUS (Dkt. 1 ). (1) The petition for writ of habeas corpus is GRANTED in part as follows: a. Within fourteen days of this order, respondents must either release petit ioner or provide him a bond hearing under 8 U.S.C. § 1226(a).b. Respondents must create a contemporaneous record, by audio recording or transcript, of any subsequent bond hearing for petitioner.c. If petitioner is released, respondents m ust return to him any personal property, including any personal identification document (other than a passport) and any employment authorization document.d. Nothing in this order prevents an Immigration Judge from granting a request by petitioner for a continuance in his bond proceedings.(2) The petition for writ of habeas corpus (Dkt. 1 ) is DENIED with respect to petitioner's remaining claims including his request for immediate release and any remaining claims for declaratory or injunctive relief.(3) The Court will consider an appropriate post-judgment motion for attorney's fees as requested in the petition.(4) The Clerk shall provide a copy of this order to counsel for petitioner and counsel for respondents.
