TEXT ORDER: In light of Buele Morocho v. Warden Philadelphia FDC, Nos. 26-1150 & 26-1454 (3d Cir. Aug. 28, 2026), and because the Court is considering the appropriate remedy, Respondents shall, within 7 days, file a supplemental notice stating whether Petitioner has any criminal history or other history that Respondents contend bears on whether Petitioner presents a danger to the community or a risk of flight. If Respondents contend that Petitioner has such history, they shall identify it with specificity and attach the supporting record(s). If Respondents contend that Petitioner has no such history, or if they identify none, they shall so state. The supplemental notice shall be limited to the foregoing issue and shall not reargue the merits of the Petition or the applicability of Buele Morocho.
