Baker on 08/26/2026: According to Petitioner's allegations in the petition (Doc. 1), although she is the subject of a final order of removal, she was rearrested by immigration authorities after her initial release from custody and has been detained for more than six months. There is no indication in the petition that immigration authorities complied with applicable regulations governing revocation of release (see 8 C.F.R. sec. 241.4 et seq.) or that changed circumstances exist or that there is a significant likelihood that removal may be effectuated in the reasonably foreseeable future (see 8 C.F.R. sec. 241.13 et seq.). Under similar circumstances, this Court has granted the writ of habeas corpus and ordered a petitioner be immediately released. See, e.g., Singh v. Warden, No. 1:26-cv-01775-JLT-CDB (HC), 2026 WL 934273 (E.D. Cal. Apr. 7, 2026), F&R adopted by 2026 WL 1399248 (E.D. Cal. May 19, 2026); Hoang v. Chestnut, No. 1:26-cv-04023-JLT-CDB (HC), 2026 WL 1875880 (E.D. Cal. June 30, 2026), F&R adopted by 2026 WL 1965614 (E.D. Cal. July 7, 2026). Accordingly, pursuant to 28 U.S.C. § 2243, the Court directs Respondents to SHOW CAUSE in writing no later than 9/4/2026 as to whether there are any factual or legal issues in this case that render it distinct from the Court's prior orders in the cases listed above and would justify denial of the writ. Respondents' response SHALL be filed and served upon Petitioner and SHALL provide copies of referenced/relevant portions of Petitioner's A-File and other supporting documents, including notices to appear, orders relating to Petitioner's release from custody, and documents related to any asserted violations of release conditions or any asserted change of circumstances warranting Petitioner's re-detention.
