MEMORANDUM OPINION AND ORDER. Respondents Response to the Petition for Writ of Habeas Corpus and Motion to Dismiss and, in the Alternative, for Summary Judgment, (Dkt. No. 16 ), is DENIED. Petitioners Petition for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241, by a Person Subject to Unlawful Detention, (Dkt. No. 1 ), is GRANTED in part and DENIED in part. Petitioners Emergency Motion for Temporary Restraining Order and/or Preliminary Injunction, (Dkt. No. 2 ), is DENIED as moot. The Court ORDERS Respondents to provide Petitioner a bond hearing under 8 U.S.C. § 1226(a) by January 20, 2026. If Petitioner is not provided a bond hearing, Respondents are ORDERED to release Petitioner by January 20, 2026. If Petitioner is released, Respondents must notify Petitioners counsel of the exact time and location of release no less than two hours before his release.
