ORDER: Before the Court is Petitioner's motion for a Temporary Restraining Order enjoining Respondents from transferring Petitioner from New York or removing Petitioner from the United States pending the Court's consideration of Petitioner's petition for a writ of habeas corpus. Upon due consideration of Petitioner's motion, the Court hereby orders that Respondents are enjoined from transferring Petitioner from New York or removing Petitioner from the United States. No security is required. This Order shall remain in place until August 20, 2026, at 12 pm. Respondents shall submit opposition to Petitioner's motion no later than August 18, 2026, at 5 pm. ORDER: On August 15, 2026, petitioner Stalyn Siguenza Chavez filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241, Dkt. 1, as to which Judge Jed S. Rakoff, sitting in Part I, set a briefing schedule. On August 17, 2026, the above-captioned case was assigned to this Court. Accordingly, IT IS HEREBY ORDERED that: 1. Respondents are ORDERED to file a return on the order to show cause as to why the petition for a writ of habeas corpus should not be granted by Friday, August 21, 2026, at 5 p.m. 2. Petitioner shall file any reply by Monday, August 24, 2026, at 5 p.m. 3. For avoidance of doubt, the hearing scheduled by Judge Rakoff for August 19, 2026 is adjourned sine die. Counsel may confer regarding the above deadlines and if all parties consent to extensions they may make the request to the Court by letter.
