ORDER - Petitioner filed a petition for writ of habeas corpus challenging his immigration detention. (Doc. 1 .) Respondents' response notes petitioner is detained under 8 U.S.C. § 1225(b)(1)(B)(ii), persons detained under that statute have no "protected liberty interest in freedom from detention because they are required to be detained by statute," and they have no "substantive due process right to a bond hearing" based on the Nation's history and tradition. (Doc. 6 at 2, 4-6 (citing Dept of Homeland Sec. v. Thuraissigiam, 591 U.S. 103 (2020)).) As petitioner notes (Doc. 10 ), the Ninth Circuit recently held that Thuraissigiam allows aliens detained under 8 U.S.C. § 1225(b)(1)(B)(ii) to pursue due process challenges and interpreted Thuraissigiam to be "an admission, not a detention, case." Padilla v. United States Immigr. & Customs Enf't, --- F.4th ----, 2026 WL 2822044, at *11, *19 (9th Cir. Sept. 21, 2026). Based on a historical analysis, Padilla further described the "freedom from arbitrary imprisonment" as occupying "a central place" in our constitutional order and constrained by "the widespread availability of bail as well as judicial review of the legality of confinement," with "noncitizens and citizens alike [being] able to use these mechanisms to obtain release from detention." Id. at 18. In light of Padilla and subsequent developments in petitioner's immigration case that Padilla may affect (see Docs. 8, 9 ), IT IS ORDERED within seven days respondents must file a supplemental response of no more than ten pages addressing whether petitioner is entitled to release or a bond hearing. Petitioner may file a response to the supplemental briefing, of no more than ten pages, within seven days of when that briefing is filed. Ordered by Judge Krissa M Lanham on 9/25/2026.
