TEXT ORDER. Before the Court are Jean Hermilus's first and second petitions for habeas corpus under 28 U.S.C. § 2241. (ECF Nos. 1 & 5 .) The legal issues presented by these petitions are the same as those issues before the court in several other cases including in Elias v. Hyde, et al., No. 1:25-cv-540-JJM-AEM (D.R.I. October 27, 2025) and Rodriguez v. Nessinger, No. 25-cv-505-MSM, 2025 (D.R.I. Oct. 17, 2025). Finding the factual circumstances and legal issues to be nearly identical, this Court GRANTS Mr. Hermilus's habeas petitions. (ECF Nos. 1 & 5 .) The Government is ORDERED to provide him with a bond hearing before an immigration judge pursuant to 8 U.S.C. § 1226(a) within thirty days of the date of this order. Further, the Government is ORDERED to release Mr. Hermilus immediately pending the bond hearing. The Government may set minimal conditions that will reasonably assure his appearance at the bond hearing. Finally, the Court ORDERS the Government to file a status report within five days of the ordered bond hearing, stating whether bond was granted and if bond was denied setting forth the specific reasons for that denial.
