ELECTRONIC ORDER: Before the Court is a Motion for Temporary Restraining Order (the "Motion") [Doc. 2] filed by Petitioner Freddie Luboya Musangu. Petitioner challenges his imminent third-country removal to Equatorial Guinea and urges the Court to stay his removal pending adjudication of his Petition for Writ of Habeas Corpus [Doc. 1]. Petitioner alleges that he had previously been released from confinement by another court and files this renewed habeas petition challenging the "absence of constitutionally and regulatorily sufficient process before the Government again deprived Mr. Musangu of liberty." The Court held an expedited telephonic hearing with counsel for Petitioner and the government. Considering the limitations on the jurisdiction of this Court pursuant to 8 USC 1252(g) and on the showing made by Petitioner, the Court declines to enter ex parte injunctive relief staying his removal. Accordingly, the Motion is denied. The court directs the clerk of court to serve the respondents forthwith and refers the Petition for Writ of Habeas Corpus [Doc. 1] to the Magistrate Judge to issue an expedited briefing schedule and, thereafter, a report and recommendation on the merits of Petitioner's claims.
