FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Chi Soo Kim on 9/29/2026 RECOMMENDING the 1 Petition for Writ of Habeas Corpus be granted on due process grounds (claim one). Respondents be ordered to immediately release petitioner Zhijie Song (A-242-254-323) and be ordered to provide petitioner with a copy of the release order at or near the time of release. At the time of release, respondents shall return to petitioner any and all of his possessions and documents (e.g., identificati on, passport, work permit, Social Security card, etc.). Respondents be enjoined and restrained from re-detaining petitioner unless the government demonstrates, by clear and convincing evidence at a pre-deprivation bond hearing before a neutral decisi onmaker, that petitioner is a flight risk or danger to the community such that physical custody is legally justified.
