MINUTE ORDER Granting in Part Petition. Although Petitioner seeks release from detention on the basis that his arrest was unlawful, Respondents' 13 Supplemental Response demonstrates that Petitioner was arrested pursuant to an administrative warrant issued prior to Petitioner's arrest based on Petitioner's criminal history of "Manufacturing/Possession and Sale of Undetectable Firearms." (See ECF Nos. 13-1, 13-2 at 4.) The Court therefore DENIES IN PART the 1 Petition to the extent Petitioner seeks release from detention on the grounds that his arrest violated his due process rights. Respondents, however, "do not oppose an order from this Court directing a bond hearing be held pursuant to 8 U.S.C. § 1226(a)." (See ECF No. 10 at 2.) The Court therefore GRANTS IN PART the 1 Petition and ORDERS Respondents to provide Petitioner with an individualized bond hearing under 8 U.S.C. § 1226(a) within fourteen (14) days. Respondents SHALL NOT DENY Petitioner's bond on the basis that 8 U.S.C. § 1225(b)(2) requires mandatory detention.
