ORDER deferring ruling on 16 Motion to Enforce; deferring ruling on 16 Motion for Writ of Habeas Corpus; deferring ruling on 16 Motion for Summary Judgment; denying 16 Motion for TRO. This case poses multiple interwoven issues. The Court does not presently endeavor to resolve the entirety of this case, but it will address the most pressing matters before it. First, although Petitioner has been detained well in excess of six months, the Government has represented that a final order of removal to a third country has been issued and continued detention is only anticipated until a deportation flight can be arranged. (ECF No. 10 at 1). The Court finds that this representation, coupled with the fact that Petitioner has been moved to Louisiana, (ECF No. 16 at 3), is sufficient evidence for the Court to conclude that removal is likely in the reasonably foreseeable future. For that reason, the Court holds that Petitioner is not entitled to release under Zadvydas v. Davis, 533 U.S. 678, 701-02 (2001) at this time. Alexander v. Atty Gen. of US, 495 F. Appx 274, 276 (3d Cir. 2012). As a corollary, the Court will not adopt the Report and Recommendation at ECF No. 14 at this juncture. Second, insofar as Petitioner seeks a Temporary Restraining Order (T.R.O.) barring his removal from the country, (ECF No. 16 at 10), the Court lacks jurisdiction to issue such an Order. Khalil v. President, United States, 164 F.4th 259, 281 (3d Cir. 2026) (The immigration laws enacted by Congress ordinarily require an alien to challenge his deportation [in a Petition for Review with the relevant Circuit Court of Appeals]-unless he raises questions that a court of appeals could not meaningfully review in that context.); Turcios v. Oddo, No. 3:25-CV-83, 2025 WL 1904384, at *3 (W.D. Pa. July 10, 2025) (As a result of Sections 1252(a)(5) and (b)(9), district courts lack jurisdiction to review most claims that even relate to removal [b]ecause judicial review of a final order is available only in the court of appeals, district courts cannot remove [] arising from claims either.) (cleaned up). Third, insofar as Petitioner seeks a T.R.O. ordering his return to this District, (ECF No. 16 at 10), the Court lacks jurisdiction to require Respondents to house an alien pending removal or a decision on removal in a particular location. T.A. v. Oddo, et al., 3:25-cv-425, ECF No. 13 (W.D. Pa. Nov. 25, 2025) (collecting legal principles in support of that conclusion). Further, Respondents have not violated an Order of this Court by moving Petitioner to Louisiana. Therefore, insofar as Petitioner seeks a T.R.O. via ECF No. 16, the Court DENIES that request. In concluding, the Court reiterates that the foregoing is not a complete resolution of the issues before the Court in this matter. At this time, the Court only intends to address the emergency matters before it. The Court's plan is to issue a more extensive Order during the upcoming week more fully explaining the foregoing conclusions and also addressing the other relevant legal issues before it.
