The motion demonstrates that Ms. Soto is admitted to practice in New York and is a member in good standing of the courts in which she is admitted. TEXT ORDER: The Court has reviewed the Petition (ECF No. 1) and Respondents' response (ECF No. 6). Respondents represent that Petitioner is subject to an administratively final order of removal and has been detained pursuant to that order since August 1, 2026. Because Petitioner is subject to a final order of removal, his detention is governed by 8 U.S.C. § 1231(a). See Guerrero-Sanchez v. Warden York Cnty. Prison, 905 F.3d 208, 219-20 (3d Cir. 2018). Further, Petitioner has not demonstrated that his approximately one-month detention violates Zadvydas v. Davis, 533 U.S. 678 (2001). Accordingly, the Petition is DENIED WITHOUT PREJUDICE.
