MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 08/18/2026. Petitioner, Tamar Black (A 066-261-950), a self-represented immigration detainee, filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Petitioner's motion to proceed in forma pauperis 2 is GRANTED and petitioner is authorized to proceed in forma pauperis without prepayment of the filing fee in this action. Respondents are directed to respond to the petition within 7 days from the date of this order. Respondents shall substantively address whether there are any factual or legal issues that materially distinguish this case from Pham v. Warden, No. 1:25-cv-01873-DC-AC (HC), 2026 WL 849861 (E.D. Cal. Mar. 27, 2026), Mena P. v. Warden, No. 1:26-cv-04606-TLN-JDP, 2026 WL 1846728 (E.D. Cal. June 25, 2026), and other similar cases previously decided by this court. The court will construe failure to distinguish the above cited cases as a concession that the cases are not substantively distinguishable. Any response must include petitioner's Form I-213 for each immigration encounter, any orders of release or detention, any custody warrants or notices, and, if respondents dispute any factual representations in the operative petition, any and all documents necessary to support their view of the facts. Petitioner's reply, if any, is due within 7 days after being served a copy of respondent's response. (Text Only Entry) (Deputy Clerk JAA) (Entered: 08/18/2026)

MINUTE ORDER issued by Courtroom Deputy for Magistrate Judge Allison Claire on 08/28/2026. Respondents have answered the petition. ECF No. 8. Based on this answer, the court agrees the cases cited by this court in the 7 briefing order are materially distinguishable because petitioner does not have a final order of removal. Upon further review of the petition, the court finds that, liberally construed, the 1 petition for writ of habeas corpus asserts a substantive due process claim under the Fifth Amendment based on prolonged and/or indefinite detention. In light of the complexity of the legal issues involved and in the interest of justice, petitioner's motion for appointment of counsel 3 is GRANTED. The Federal Defender is directed to identify counsel to represent petitioner. The Clerk of the Court shall serve a copy of this order on the Federal Defender, Attention: Habeas Appointment. Within 7 days of this order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information to the undersigned's courtroom deputy Jonathan Anderson at janderson@caed.uscourts.gov, and counsel will be added as counsel for petitioner. If counsel is not a member of the Eastern District of California Criminal Justice Act ("CJA") Panel, the Court hereby authorizes them to serve as CJA counsel for petitioner for the duration of the proceedings in this Court pursuant to Local Rule 180(b)(1). Within 7 days of adding counsel for petitioner, petitioner's counsel shall file a reply in support of the petition. Petitioner's reply shall substantively address whether petitioner's removal to Jamaica, after all appellate procedures are completed, is significantly likely. See Prieto-Romero, 534 F.3d 1053, 1063-65 (9th Cir. 2008); Diep v. Chestnut, No. 1:26-cv-1664 DC DMC, 2026 WL 2186533 (E.D. Cal. July 29, 2026). Within 7 days from the date the reply is filed, respondents shall substantively address the same question. (Text Only Entry) (Deputy Clerk JAA) (Entered: 08/28/2026)
