ORDER Upon review of Petitioner's Application 1, Motion for Temporary Restraining Order 5, and Notice of Proof of Service 11, and Motion for Order Pending TRO/PI 12 the facts of this case appear to be controlled by the Court's recent analysis in Mendoza Gutierrez v. Baltasar, No. 25-CV-2720-RMR, 2025 WL 2962908, at *1 (D. Colo. Oct. 17, 2025). Petitioner appears to be a member of the class of individuals the Court conditionally certified and enjoined the Government from removing from the United States or transferring from the District of Colorado in Gutierrez v. Baltasar, No. 25-CV-2720-RMR, 2025 WL 3251143, at *3 (D. Colo. Nov. 21, 2025), except here Petitioner is requesting relief pursuant to Bautista v. Santacruz, No. 5:25-CV-01873-SSS-BFM, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025), reconsideration granted in part, No. 5:25-CV-01873-SSS-BFM, 2025 WL 3713982 (C.D. Cal. Dec. 18, 2025), and amended and superseded on reconsideration sub nom. Lzaro Maldonado Bautista et al., v. Ernesto Santacruz Jr et al. Additional Party Names: Franco Galdamez, No. 5:25-CV-01873-SSS-BFM, 2025 WL 3713987 (C.D. Cal. Dec. 18, 2025), judgment entered sub nom. Maldonado Bautista v. Noem, No. 5:25-CV-01873-SSS-BFM, 2025 WL 3678485 (C.D. Cal. Dec. 18, 2025) It is ORDERED that Respondents shall promptly enter their notices of appearance. Within seven days of this ORDER, Respondents shall RESPOND to the Application and Motion and SHOW CAUSE why the Petition and Motion shall not be granted. In their Response, Respondents must address: 1) whether Petitioner is a member of the class in Gutierrez and confirm that pursuant to this Courts order in Gutierrez, Petitioner will not be removed from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates the Courts order in Gutierrez, and 2) whether the present case differs factually or legally from Gutierrez or the declaratory judgment issued in Maldonado Bautista v.
