TEXT ORDER: This matter comes before the Court upon Petitioner's petition for writ of habeas corpus challenging his immigration detention as unlawful (ECF No. 1, Petition), Respondents advised the Court in writing that Petitioner was transferred to Pennsylvania before the Petition was filed and sought transfer of this matter to the Western District of Pennsylvania. (ECF No. 6, Letter.) Petitioner replied that he met with his attorney at Elizabeth Detention Center to prepare the Petition on the day of his transfer, and his counsel had made an appointment the next day for Petitioner to review and sign the Petition, but Petitioner was transferred out of New Jersey overnight without notice to Petitioner or his counsel. (ECF No. 8, Letter). The Petition was filed and named Petitioner's immediate custodian at the time counsel prepared the Petition, Jason Benzel, Warden Elizabeth Detention Center, before Petitioner was transferred without notice. Under these unusual circumstances, it is ORDERED that Respondents shall return Petitioner to New Jersey within 48 hours, and the Court retains jurisdiction and venue in this matter.
