Judge Richard G. Stearns: ELECTRONIC ORDER entered re 8 Response to Petition for Writ of Habeas Corpus - 2241 filed by Homeland Security, ICE. In his petition, Pojoy Meono Leonel Virguilio asserts that he has been detained by United States Department of Homeland Security (ICE) for more than six months in violation of Zadvydas v. Davis, 533 U.S. 678 (2001) and that he holds an approved I-130. The government responds simply arguing that ICE issued a final Order of Removal for petitioner on June 12, 2026, and that [t]here is therefore no colorable argument that Petitioners detention violates the Constitution. Govt Response at 4. While a Form I-130 has no affect on Leonel Virguilios legal status, an assertion of Zadvydas might. Accordingly, the court directs the government to inform the court, no later than Friday August 28, 2026, how long petitioner has been in detention (the date he was detained), his country of citizenship, and to where and when they intend to remove him.(MZ) (Entered: 08/21/2026)
