Additionally, the Court notes that it has addressed the legal issues raised by petitioner's detention claims (claims one, two, and three in the petition) on previous occasions. See e.g., Lepe v. Andrews, No. 1:25-CV-01163-KES-SKO (HC), 2025 WL 2716910 (E.D. Cal. Sept. 23, 2025); J.A.C.P. v. Wofford, No. 1:25-CV-01354-KES-SKO (HC), 2025 WL 3013328 (E.D. Cal. Oct. 27, 2025). Respondents are directed to substantively respond as to any provisions of law or fact in this case which would distinguish the analysis of petitioner's detention claims from the analysis of the detention claim in Lepe v. Andrews, No. 1:25-CV-01163-KES-SKO (HC), 2025 WL 2716910 (E.D. Cal. Sept. 23, 2025), and other similar cases previously decided by this Court, or indicate the matter is not substantively distinguishable as to the detention claims. The parties shall indicate in their briefing their position as to whether the 6 motion for temporary restraining order should be converted into a motion for preliminary injunction.
