TEXT ORDER This matter comes before the Court upon Petitioner's petition for writ of habeas corpus under 28 U.S.C. 2241, (Dkt. No. 1, Petition), and Respondents' expedited answer to the Petition, (Dkt. No. 6, Answer), disclosing Petitioner's criminal history. Petitioner alleges he is a native and citizen of Mexico who entered the United States withoutinspection in 2021, he was not apprehended at or near the border or close in time to his entry, and he is not subject to a final order of removal. (Petition at 9.) If Respondents contest these factual allegations, they shall file a supplemental answer within 14 days of this Order. If Respondents do not contest these factual allegations, this Court holds that Petitioner is detained under 8 U.S.C. 1226(a) and entitled to a bond hearing under 8 C.F.R. 1236.1(d)(1) and 8 C.F.R. 1003.19, see Lemu v. Soto, No. CV 25-17098 (RMB), 2025 WL 3470298, at *3 (D.N.J. Dec. 3, 2025), and Respondents shall provide Petitioner with a bond hearing within ten (10) days of this Order.
