MINUTE ORDER signed by District Judge Vince Chhabria on 8/11/2026: The Court has reviewed Petitioner's Petition for Writ of Habeas Corpus (ECF No. 1 ) and Motion for Temporary Restraining Order (ECF No. 2 ). The issues raised therein appear to mirror those previously addressed by the Court and others in many prior cases. See Simon v. Warden, Cent. Valley Annex, No. 1:26-CV-05030 (EJD), 2026 WL 1992936 (E.D. Cal. July 9, 2026); Palacios Ortega v. Chestnut, No. 1:26-CV-04151 (EJD), 2026 WL 2130161 (E.D. Cal. July 23, 2026); Romain v. Warden, Central Valley Annex, No. 1:26-CV-04154 (VC), 2026 WL 2130249 (E.D. Cal. July 23, 2026); Kumar v. Warden, Golden State Annex, No. 1:26-CV-04109 (EJD), 2026 WL 2163563 (E.D. Cal. July 27, 2026). On or before 8/17/2026, Respondents are ordered to show cause as to whether there are any factual or legal issues in this case that render it distinct from the cases listed above and would justify denial of a preliminary injunction. Respondents should also state whether they oppose this Court converting the Motion for Temporary Restraining Order to a Motion for Preliminary Injunction, or alternatively, ruling on the underlying habeas petition in its entirety. Petitioner may file a reply on or before 8/20/2026. Respondents are PROHIBITED from transferring Petitioner while the 1 habeas petition and 2 TRO are pending. The matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. Counsel for Respondents shall promptly enter notices of appearance. (Text Only Entry) (Thomas, Julia) The Court further finds this case would benefit from the appointment of counsel. See 18 U.S.C. § 3006A(a)(2)(B). Within 7 calendar days from the date of this Order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information via email to julia_thomas@CAND.uscourts.gov, who shall update the docket to reflect counsel's appointment. If counsel is not a member of the Eastern District of California Criminal Justice Act ("CJA") Panel, the Court hereby authorizes the appointee to serve as CJA counsel for Petitioner for the duration of the proceedings in this Court pursuant to Local Rule 180(b)(1). If counsel is not admitted to practice before the Eastern District of California court, pursuant to 18 U.S.C. §§ 3005 and 3006A and this District's CJA Plan, General Order 671, § XV.C.1.g as applied here, the Court hereby authorizes said counsel's Pro Hac Vice admission to practice before this court for the duration of the proceedings, nunc pro tunc to the date the appointing authority first contacted counsel about this appointment. The Clerk of the Court SHALL SERVE a copy of this Order on the Federal Defender, Attention: Habeas Appointment. The Clerk shall also serve a copy of the 1 Petition upon the Federal Defender.
